Defective Workmanship Material and/or Design – Car

DEFECTIVE WORKMANSHIP, MATERIAL AND/OR DESIGN – CAR #

It is expressly agreed that in respect of claims for loss or damage to the works where the immediate cause is defective workmanship, material and/or design, the indemnity provided shall include cost of rectifying such defective workmanship, material and/or design.

There shall however, be no indemnity in respect of :

1. the additional cost introducing improvement or corrections in the rectification of the workmanship, material and/or design responsible for such loss or damage
2. the first …………….. in respect of every such claim, in no event shall more than one excess apply in respect any one occurrence of loss or damage.
